A BILL TO BE ENTITLED
|
|
 
|
AN ACT
|
|
 
|
relating to the authority of a political subdivision to use public |
|
 
|
money to provide legal services for individuals unlawfully present |
|
 
|
in the United States. |
|
 
|
             BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
 
|
             SECTION  1.    Chapter 140, Local Government Code, is amended |
|
 
|
by adding Section 140.014 to read as follows: |
|
 
|
             Sec.  140.014.    PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE |
|
 
|
LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless required |
|
 
|
by the United States Constitution, a political subdivision may not: |
|
 
|
                         (1)    use public money to provide legal services for an |
|
 
|
individual who is unlawfully present in the United States according |
|
 
|
to the terms of the federal Immigration and Nationality Act (8 |
|
 
|
U.S.C. Section 1101 et seq.); or |
|
 
|
                         (2)    provide public money to a person to be used to |
|
 
|
directly or indirectly provide legal services for an individual |
|
 
|
described by Subdivision (1). |
|
 
|
             SECTION  2.    This Act takes effect on the 91st day after the |
|
 
|
last day of the legislative session. |
