A BILL TO BE ENTITLED
AN ACT
relating to the dismissal of a baseless or unfounded complaint
filed with the State Board of Veterinary Medical Examiners.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter E, Chapter 801, Occupations Code, is
amended by adding Section 801.2052 to read as follows:
       Sec. 801.2052.  DISMISSAL OF BASELESS OR UNFOUNDED
COMPLAINT. (a)  If the board determines that a complaint filed with
the board is baseless or unfounded, the board shall:
             (1)  dismiss the complaint; and
             (2)  include a statement in the record of the complaint
that the complaint was dismissed because the complaint was baseless
or unfounded.
       (b)  The board shall adopt rules that establish criteria for
determining that a complaint is baseless or unfounded.
       SECTION 2.  This Act takes effect September 1, 2023.
