A BILL TO BE ENTITLED
|
 
|
AN ACT
|
 
|
relating to fiscal impact statements for legislation imposing |
 
|
mandates on health benefit plan issuers. |
 
|
             BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
 
|
             SECTION  1.    Chapter 314, Government Code, is amended by |
 
|
adding Section 314.006 to read as follows: |
 
|
             Sec.  314.006.    FISCAL IMPACT STATEMENT FOR HEALTH BENEFIT |
 
|
PLAN MANDATES. (a) In this section: |
 
|
                         (1)    "Enrollee" means an individual who is enrolled in |
 
|
a health benefit plan, including a covered dependent. |
 
|
                         (2)    "Health benefit plan issuer" means an insurer, |
 
|
health maintenance organization, or other entity authorized to |
 
|
provide health benefits coverage under the laws of this state. |
 
|
                         (3)    "Health care provider" means a physician or other |
 
|
person who is licensed, certified, or otherwise authorized to |
 
|
provide a health care service in this state. |
 
|
             (b)    The board shall prepare a fiscal impact statement for |
 
|
each bill or joint resolution that requires a health benefit plan |
 
|
issuer to provide new health benefits, increase payments to health |
 
|
care providers, or implement new contractual or administrative |
 
|
requirements. |
 
|
             (c)    The fiscal impact statement must estimate the effect of |
 
|
the bill or joint resolution on health benefit plan issuer |
 
|
expenditures and on premiums and other costs paid by enrollees. |
 
|
             (d)    The fiscal impact statement must be attached to the bill |
 
|
or joint resolution immediately following: |
 
|
                         (1)    the fiscal note attached under Section 314.003; or |
 
|
                         (2)    another statement attached under this chapter. |
 
|
             SECTION  2.    Section 314.006, Government Code, as added by |
 
|
this Act, applies only to a bill or joint resolution filed on or |
 
|
after the effective date of this Act. |
 
|
             SECTION  3.    This Act takes effect September 1, 2021. |
