House Bill 2624 amends Chapter 32 of the Private Acts of 2009 concerning the charter of the City of Adamsville. The bill deletes Section 2.09 in its entirety and replaces it with new provisions regarding vacancies in the offices of Mayor or Commissioner. Under the new language, a vacancy is defined as occurring when the mayor or a city commissioner resigns, dies, relocates outside the city, or is removed from office as per Tennessee law. Additionally, individuals convicted of malfeasance, misfeasance, a felony, or a crime involving moral turpitude are prohibited from holding office for ten years. The remaining city commissioners are tasked with appointing a qualified individual to fill any vacancy, who will serve until the next regular city election, at which point any unexpired term will be filled.
Furthermore, if the city commissioners do not fill a vacancy within 45 days, the mayor is required to appoint someone to fill the vacancy within 15 days. The bill stipulates that it will only take effect if approved by a two-thirds vote of the legislative body of the City of Adamsville, with the presiding officer responsible for proclaiming and certifying the approval to the secretary of state. The act will be effective upon becoming law for the purpose of approval or rejection, while for all other purposes, it will take effect as outlined in the approval process.
