Senate Bill 2319, also known as House Bill 2449, amends Tennessee Code Annotated, Title 10, by introducing a new section that mandates public libraries to adopt a materials reconsideration policy. This policy allows legal residents of the county where the library is located to request the withdrawal, reclassification, or relocation of library items, which include physical books, electronic books, magazines, audio recordings, digital resources, and games. The bill outlines specific requirements for the reconsideration process, including the use of a standardized application form, a timeline for library board responses, and stipulations regarding the finality of decisions made by the library board.

The bill also includes provisions that allow libraries to set certain conditions for the reconsideration process, such as requiring applicants to attest to having fully engaged with the item in question and presenting valid identification. Additionally, it permits libraries to limit the number of applications an individual can submit within a year and to deny applications that are deemed disruptive. Importantly, the bill clarifies that items available through interlibrary loans are not subject to the reconsideration policy and that libraries retain the right to remove items for reasons unrelated to the reconsideration process. The act is set to take effect on July 1, 2027.
