Senate Bill 2659, also known as House Bill 2408, amends Tennessee Code Annotated to regulate telephone solicitations made using automated dialing systems. A new section, 65-4-411, is added, requiring entities that make such solicitations to maintain monthly records of their activities. Starting October 1, 2026, those making at least 500 solicitations per month must submit these records to the commission every six months and upon request. Failure to comply with these requirements may result in penalties.

Additionally, the bill establishes a cap on the number of telephone solicitations, prohibiting any entity from making more than 10,000 solicitations per month. Violating this cap is classified as an unfair or deceptive act under the Tennessee Consumer Protection Act, subjecting violators to civil penalties of at least $1,000 per violation. The bill also amends Section 47-18-104(b) to include violations of the new solicitation limit as a punishable offense. The act is set to take effect on July 1, 2026, applying to conduct occurring on or after that date.
