House Bill 2010, also known as Senate Bill 2196, amends Tennessee Code Annotated to establish new requirements for tire manufacturers and suppliers in relation to the procurement of tires by the state. The bill introduces a new section that defines key terms such as "one hundred percent (100%) French process zinc oxide," "price list or buying guide," "solicitation," and "tire manufacturer or supplier." It mandates that any tire manufacturer or supplier responding to a state solicitation must clearly identify which tires are produced with the specified zinc oxide process, including this information in all procurement documentation. Additionally, any price list or buying guide submitted must also indicate whether the tires meet this production standard.
The bill further stipulates that existing contracts for tire supply must be amended within 120 days to comply with these new disclosure requirements, with non-compliance potentially leading to contract suspension or termination. If there are changes in the manufacturing process affecting the zinc oxide content during the contract term, the supplier must update the relevant documentation within 90 days and notify the chief procurement officer and relevant state agencies. The chief procurement officer is granted the authority to create rules for the implementation and enforcement of these provisions. The act will take effect upon becoming law.
