Senate Bill 2552, also known as the "Tennessee Secondary Aluminum Waste Management Act," amends the Tennessee Code Annotated to establish regulations regarding the disposal of secondary aluminum waste. The bill defines "secondary aluminum waste" as waste materials generated from secondary aluminum smelting operations, including aluminum dross and baghouse dust. It prohibits the commingling of municipal solid waste with secondary aluminum waste in landfills and mandates that secondary aluminum waste can only be disposed of in dedicated landfill units that have been specifically permitted for this purpose. Additionally, it restricts the addition of secondary aluminum waste or municipal solid waste on top of previously filled or closed landfill units.
The bill requires the Department of Environment and Conservation to promulgate rules for the permitting and operational standards of dedicated secondary aluminum waste landfill units, ensuring the protection of human health and the environment. These rules must include criteria for permitting, performance standards, and considerations for liner design and leachate control. The act takes effect upon becoming law for the purpose of rule promulgation, while all other provisions will take effect on July 1, 2026, applying to all secondary aluminum waste and municipal solid waste disposed of after that date.
