Senate Bill 2001, also known as "The Tennessee Safe Stores and Staffed Stores Act," amends Tennessee Code Annotated to establish regulations for drug and food retail establishments that utilize self-service checkout options. The bill mandates that for every four self-service checkout stations, there must be at least one staffed checkout station available during operational hours. It also sets limits on the number of items that can be purchased through self-service checkouts to a maximum of fifteen and prohibits the purchase of certain items that require identification or special theft-deterrent measures without employee assistance. Additionally, the bill requires establishments to provide clear signage about customers' rights and to ensure that self-service checkout stations are monitored by employees.
The bill includes provisions for civil action, allowing customers or employees to sue establishments for violations, with potential penalties of up to $100 per employee for each violation and additional daily penalties for ongoing issues. It also prohibits retaliation against employees who seek to enforce their rights under the act. The act is set to take effect on January 1, 2027, and includes a severability clause to ensure that if any part of the act is found invalid, the remaining provisions will still be enforceable.
