Senate Bill 2033 amends Tennessee Code Annotated to establish new provisions regarding employment-related mental health evaluations. The bill defines "employee" as an individual performing services for an employer, excluding self-employed independent contractors, and defines "employer" as any individual or entity employing one or more employees, including state and political subdivisions. It mandates that employers who require mental health evaluations for employees or prospective employees must provide reasonable access to the evaluation results, including reports from mental health professionals, during normal business hours.

Additionally, the bill allows employees who are denied access to their mental health evaluation results to file a private cause of action against their employer for declaratory or injunctive relief. If the employee prevails in such an action, the court is required to award reasonable court costs and attorney fees. This legislation aims to enhance transparency and protect the rights of employees regarding their mental health evaluations in the workplace.
