House Bill 2023 amends Tennessee Code Annotated, Section 40-24-109, regarding the victims assistance assessment. The bill replaces subsection (c) to mandate that clerks of various courts collect a victims assistance assessment of $125 from individuals who either enter a guilty plea, are found guilty, enter a plea of nolo contendere, or are found criminally responsible for certain offenses. This includes those who plead under diversionary sentencing statutes or are involved in attempts or conspiracies related to the specified offenses.
Additionally, the bill modifies subsection (g)(1) to clarify that the victims assistance assessment is subject to existing tax laws and is in addition to other costs and fines. It specifies that $15 of each assessment will be retained by the court clerk for processing, while the remaining $110 will be allocated to the county's victims assistance program as designated by the county legislative body. The act will take effect upon becoming law.
