While associations may restrict installations in common areas, they cannot prohibit charging stations in a unit owner's designated parking space if it is located within a common area.
Additionally, the bill outlines the responsibilities of unit owners who install charging stations, requiring them to indemnify the association against any liability arising from the installation and operation of the stations. Homeowners' associations may also require owners to maintain insurance that includes the association as a named insured. The act is set to take effect on July 1, 2026, and will apply to actions taken or declarations made on or after that date.
