House Bill 1640 and Senate Bill 1881 aim to enhance the confidentiality of records held by the office of homeland security in Tennessee. The bill amends Tennessee Code Annotated, Section 10-7-504(a)(2)(A), by adding that all investigative records of the Tennessee Bureau of Investigation will now include records from the office of homeland security. Additionally, a new subdivision is introduced that specifies certain records from the office of homeland security as confidential and not open to public inspection.
The records deemed confidential include those related to protected critical infrastructure, such as security analyses, warnings, and studies, as well as records concerning the identification and prevention of terrorist or criminal threats against Tennessee's critical infrastructure. Furthermore, any records designated as confidential by the commissioner of safety or their designee will also be protected under this new legislation. The act is set to take effect immediately upon becoming law.
