Senate Bill 1441 aims to amend existing laws regarding the General Sessions and Juvenile Courts of Montgomery County, Tennessee, by establishing a fifth division within these courts. This new division will have the same jurisdiction and powers as the existing divisions. The bill also creates the position of a fifth General Sessions and Juvenile Courts Judge, who will be appointed until an election can be held in August 2026. The appointed judge will serve until September 1, 2026, after which a judge will be elected for an eight-year term, with subsequent elections occurring every eight years thereafter.
Additionally, the bill modifies the rotation of the presiding judge among the divisions. The previous requirement for the presiding judge to rotate every three years among the first three divisions has been changed to a five-year rotation that now includes all five divisions. The bill also mandates that the Montgomery County Commission provide necessary resources for the new division and expands the responsibilities of the Clerk of the General Sessions and Juvenile Courts to include the fifth division. The act will take effect upon approval by a two-thirds vote of the county legislative body.
