Senate Bill 936, also known as House Bill 1271, amends various sections of the Tennessee Code Annotated to establish a state policy that recognizes only two biological sexes: male and female. The bill mandates that by January 1, 2027, all local and state governmental entities must revise any existing rules, policies, or procedures that reference a person's sex or gender to align with this definition, which is based on immutable characteristics of a person's reproductive system as determined by their anatomy and genetics at birth. Furthermore, it prohibits the adoption of any new policies that do not conform to this definition starting July 1, 2026.

The bill also outlines a process for individuals to file complaints against governmental entities that fail to comply with these requirements. If a local or state entity is found noncompliant, they may face penalties, including ineligibility for grant contracts or withholding of general fund revenue. Additionally, the bill includes a provision that emphasizes the importance of local governance, stating that the act overrides local authority and may contradict the principle of local control. The act may be cited as the "Scientifically Incorrect Act of 2026."
