This bill requires the attorney general to post a publicly accessible listing on the attorney general's website of current litigation that could potentially impact the interpretation of this state's constitution, excluding personal civil and wrongful death suits, in which this state is a party. Unless posting the information would violate a court order or the information is otherwise confidential, this bill requires the information provided to include the following: (1) The case number, court where the case is pending, current status, and procedural history; (2) The identity of outside counsel retained by the attorney general for the case, if any; (3) The date the action was filed and whether this state is a plaintiff or defendant; and (4) The dates of upcoming hearings related to the case. This bill also requires the attorney general to provide an annual report on the status of litigation of the cases listed above resulting in a final disposition by the end of each fiscal year and post the report on the attorney general's publicly accessible website. Unless posting the information would violate a court order or the information is otherwise confidential, this bill requires the annual report to include the following for each case: (1) The final disposition; (2) The amount of damages this state was ordered to pay or the amount of damages received by this state; and (3) The amount this state was ordered to pay in attorney's fees, and the cost of retaining outside counsel, if applicable. This bill requires the annual report to remain posted on the website for one fiscal year and to be archived once a new annual report is posted.
