Present law requires that, when the owner of a self-service storage facility enforces a lien on personal property located at the self-service storage facility by public sale, the owner must advertise the sale by publication in a newspaper of general circulation. This bill makes publication in a newspaper optional and specifies that the manner of advertisement will be deemed commercially reasonable if at least three potential bidders participate in the sale at the time and place advertised. ON MARCH 5, 2020, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 543, AS AMENDED. AMENDMENT #1 adds authorization to hold an online sale to enforce a lien on personal property located at a self-service storage facility, authorizes self-storage facility owners to contact county clerks to determine the owner and any lienholder for a motor vehicle left in a self-storage unit, and changes this bill's effective date to July 1, 2020. ON MARCH 12, 2020, THE HOUSE SUBSTITUTED SENATE BILL 543 FOR HOUSE BILL 1073, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 543, AS AMENDED. AMENDMENT #1 clarifies, in regard to the present law requirement that certain notice be given regarding enforcement of a lien on a motor vehicle, that the required notice is from the self-storage facility owner to the owner of the motor vehicle.
