House Bill 40, also known as Senate Bill 239, mandates the Tennessee Advisory Commission on Intergovernmental Relations (TACIR) to conduct a study on the availability of local juvenile detention centers and treatment facilities for juveniles. The study will assess the current resources for housing and treatment of juveniles detained before adjudicatory hearings, as well as those who have been adjudicated delinquent and committed to the custody of the Department of Children's Services. TACIR is authorized to request information from relevant state and local governmental entities to aid in this study, which will be conducted using existing resources.

The findings and recommendations from TACIR, including any proposed legislation, must be reported to each member of the General Assembly and provided to the legislative librarian by January 1, 2026. The act will take effect upon becoming law, emphasizing the importance of addressing the needs of juvenile offenders in Tennessee.
