By Sexton AN ACT to amend Tennessee Code Annotated, Title 16
and Title 17, relative to the board of judicial conduct.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 17-5-303, is amended by adding the following new subsection:
(i)
(1) Prior to entering into a deferred discipline agreement, the investigative panel must require the judge to sign an affidavit stating that:
(A) The judge consents to the recommendation of the investigative panel;
(B) The consent is freely and voluntarily rendered;
(C) There is a pending proceeding involving allegations of
misconduct, which must be specifically set forth in the affidavit; and
(D) The facts set forth in the affidavit are true.
(2) The affidavit must be filed with the board upon its approval by the hearing panel.
SECTION 2. This act takes effect July 1, 2024, the public welfare requiring it.
