By Mitchell AN ACT to amend Tennessee Code Annotated, Title 39,
relative to threats of mass violence.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 39-16-517(b), is amended by
deleting "Class A misdemeanor" and substituting "Class E felony".
SECTION 2. This act takes effect July 1, 2024, the public welfare requiring it, and applies to offenses committed on or after that date.

by deleting all language after the enacting clause and substituting:
SECTION 1. Tennessee Code Annotated, Section 39-16-517, is amended by deleting subsection (b) and substituting:
(b)
(1) A person who recklessly, by any means of communication, threatens to commit an act of mass violence on school property or at a school-related activity commits a Class E felony.
(2) This section does not apply to a person with an intellectual disability,
as defined in § 33-1-101.
SECTION 2. This act takes effect July 1, 2024, the public welfare requiring it, and applies to offenses committed on or after that date.
