NURSING HOME ASSESSMENT TRUST FUND
Present law requires the nursing home assessment trust fund to be used to make expenditures for nursing facility services under the TennCare program for fiscal year 2023-2024 at the full rates for the specified fiscal year as provided for under bureau of TennCare rules relative to the acuity- and quality-based reimbursement system and in accordance with existing law. This bill revises this provision by requiring the nursing home assessment trust fund to be used to make expenditures for nursing facility services under the TennCare program for fiscal year 2024-2025.
PAYMENT OF ASSESSMENTS
Present law requires each nursing home to pay the nursing home assessment in quarterly installments. Present law provides that the total aggregated amount of assessments for all nursing facilities from July 1, 2023, through June 30, 2024, is equal to 6 percent of the net patient service revenue. This bill changes the date in the present law from July 1, 2023, through June 30, 2024, to July 1, 2024, through June 30, 2025.
Present law requires a licensed nursing home that is licensed on July 1, 2023, for 50 beds or fewer to pay an assessment rate equal to 2.75 percent of net patient service revenue, divided by all non-medicare days. The facility must pay the per diem rate for each of its non-medicare days. This bill changes the date of the present law from July 1, 2023, to July 1, 2024.
Present law requires a licensed nursing home that on July 1, 2023, either operates as part of a continuing care retirement community or is certified only to provide medicare skilled nursing facility services, to pay an assessment rate equal to 2.75 percent of net patient service revenue, divided by all non-medicare days. The facility must pay the per diem rate for each of its non-medicare days. This bill changes the date of the present law from July 1, 2023, to July 1, 2024.
Present law requires a licensed nursing home that is licensed on July 1, 2023, and provided 35,000 or greater medicaid patient days for the 12 months ending December 31 of the prior year to pay an assessment rate equal to 2.75 percent of net patient service revenue divided by all non-medicare patient days. The facility must pay the per diem rate for each of its non-medicare days. This bill changes the date of the present law from July 1, 2023, to July 1, 2024.
Present law requires a new nursing home facility that is initially licensed and commences operations on or after July 1, 2023, to pay in fiscal year 2023-2024 a prorated assessment equal to $2,225 per licensed bed per year, prorated to accrue from the date the nursing facility became licensed. The change in ownership of an existing licensed facility does not meet the requirements of this provision. This bill changes the present law by requiring the payment in the fiscal year 2024-2025.
Present law requires a licensed nursing home not meeting the criteria of the above provisions to pay an equal per facility annual assessment amount at such amount as is necessary to ensure that the total aggregated amount of assessment for all nursing facilities from July 1, 2023, through June 30, 2024, equals 6 percent of the net patient service revenue, when such total aggregated assessment amount is established on July 1 of each year. This bill changes the date in the present law from July 1, 2023, through June 30, 2024, to July 1, 2024, through June 30, 2025.
TERMINATION OF ASSESSMENT
Present law requires the nursing home annual assessment fee to terminate on June 30, 2024. This bill changes the termination date to June 30, 2025.
