ON MARCH 14, 2024, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 2046, AS AMENDED.
AMENDMENT #1 rewrites the bill to, instead, do the following:
(1) Authorize the executive director to establish a special temporary, slow no wake zone, if such zone is necessary because of an immediate danger to the public health, environment, safety, or welfare, and the nature of the necessity is such that an emergency rule under the Uniform Administrative Procedures Act ("act"), cannot immediately be sought. A special temporary, slow no wake zone authorized must be published at least one time in newspapers with circulation that generally covers the areas affected by the establishment of the zone. However, this amendment does not remove the requirement to subsequently file an emergency rule in accordance with the act, as soon as practicable; and
(2) Change the present law provision establishing that it is unlawful for any person or persons to operate any vessel subject to registration or any commercial vessel on the public waters of the state while under the influence of any intoxicant, marijuana, narcotic drug, or drug producing stimulating effects on the central nervous system to, instead, refer to the "waters of Tennessee, as defined in state law" instead of the "public waters of the state".
