ON MARCH 25, 2024, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 1640, AS AMENDED.
AMENDMENT #1 rewrites the bill to, instead, do the following:
(1) Except as provided in (3) below, establish that all permanent rules filed in the office of the secretary of state on or after January 1, 2023, that are in effect on the effective date of the bill, and that are scheduled for expiration on June 30, 2024, do not expire on June 30, 2024, but remain in effect until repealed or amended by subsequent rule of the appropriate rulemaking agency or until otherwise superseded by legislative enactment;
(2) Establish that the bill is not to be construed to justify the continued effectiveness of any rule that remains in effect under (1) above if the rule conflicts with the provisions of any legislative enactment other than the Uniform Administrative Procedures Act;
(3) Require the following rules to expire on the effective date of the bill:
(A) Board of Pharmacy Rule Number 1140-07-.01 through Rule Number 1140-07-.10, relative to sterile product preparation in pharmacy practice, and filed in the office of secretary of state on December 15, 2023; and
(B) Board of Pharmacy Rule Number 1140-07-.01 through Rule Number 1140-07-.10, relative to compounding, and filed in the office of secretary of state on December 15, 2023.
