This bill enacts the "Keeping our Streets Safe: Expand Background Checks Act" to change present law concerning data reporting.
Present law requires courts to report any adjudication that results in a person being found a mental defective or committed to a mental institution. Any such report must be made to the department of safety and the FBI as soon as practicable, but no later than the third business day following the date of the order or adjudication. This bill changes the reporting deadline to within 72 hours following the date of the order or adjudication. This bill makes a similar change concerning the time within which hospitals must report to the department and the FBI the involuntary commitment of a patient to inpatient treatment.
Present law also requires courts to notify the TBI of the final disposition of a criminal proceeding within 30 days after such disposition. This bill changes the reporting deadline to with 72 hours after such disposition.
