By Akbari AN ACT to amend Tennessee Code Annotated, Title 29,
Chapter 3, Part 1; Title 39 and Title 40, relative to
offenses related to inducing or coercing a minor to
commit an offense.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Title 39, Chapter 17, Part 13, is amended by
adding the following section:
(a) It is an offense for a criminal gang member, as defined in § 40-35-121,
eighteen (18) years of age or older, by means of oral, written or electronic communication, electronic mail or internet services, directly or through another, to intentionally coerce or induce, including, but not limited to, offering membership in a criminal gang, as defined in § 40-35-121, a person whom the criminal gang member making the solicitation knows, or reasonably should know, is less than eighteen (18)
years of age, to engage in conduct that, if completed, would constitute theft of a firearm.
(b) A violation of subsection (a) is a Class D felony.
(c) A person in violation of subsection (a) is criminally responsible, as defined in
§§ 39-11-401 and 39-11-402, for any crime that occurs from the minor's use of the stolen firearm.
SECTION 2. This act takes effect October 1, 2023, the public welfare requiring it.
