SENATE BILL 7037
By Oliver AN ACT to amend Tennessee Code Annotated, Title 39,
relative to stalking.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 39-17-315, is amended by adding the following new subsection:
(1) If a person commits stalking, aggravated stalking, or especially aggravated stalking, and the offense was committed because of the victim's status as a healthcare provider who performs abortions, then the offense is a hate crime and shall be punished one (1) classification higher than otherwise provided in this section.
(2) As used in this subsection ( ), "healthcare provider" means a healthcare professional licensed, registered, certified, or permitted pursuant to title 63 or title 68 and regulated under the authority of either the department of health or an agency, board,
council, or committee attached to the department of health.
SECTION 2. This act takes effect October 1, 2023, the public welfare requiring it.
