By Parkinson AN ACT to amend Tennessee Code Annotated, Title 39,
relative to mass violence.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 39-17-1303, is amended by deleting subsection (d) in its entirety and substituting instead the following:
(d)
(1) A violation of subsection (a) is a Class A misdemeanor.
(2) A person in violation of subdivision (a)(1) is criminally responsible, as defined in §§ 39-11-401 and 39-11-402, for:
(A) A threat of mass violence, as defined in § 39-16-517, in which the minor threatens the use of the firearm that was unlawfully sold,
loaned, or gifted to the minor; or
(B) A criminal act, which leads to, or which a reasonable person would conclude could lead to, the serious bodily injury or the death of two
(2) or more persons, that occurs from the use of the firearm that was unlawfully sold, loaned, or gifted to the minor.
SECTION 2. This act takes effect October 1, 2023, the public welfare requiring it.
