The bill introduces a new section to South Dakota law that allows hotels, campgrounds, and RV parks to eject individuals who do not check out or pay for their accommodations by the scheduled time. Before ejection, the establishment must request the individual to leave via electronic mail, text message, or printed notice. If the individual does not comply within twenty-four hours of receiving this request, the establishment can then involve law enforcement to remove the individual.

Additionally, the bill establishes that individuals who refuse to leave after the request will be guilty of a Class 1 misdemeanor. It also provides a legal recourse for individuals who are wrongfully ejected, allowing them to file a civil action for equitable relief, damages, and reasonable attorney's fees.
