This bill aims to prohibit the public dissemination of location information regarding current or former public officers, as well as their family or household members, without consent. Specifically, it makes it illegal to share such information with the intent to harass, intimidate, or threaten the public officer or their family, or to instill a reasonable fear for their safety. Violating this provision is classified as a Class 6 felony.
Additionally, the bill establishes a civil cause of action for public officers whose location information has been unlawfully disseminated. This allows affected officers to seek punitive, special, and general damages, including compensation for emotional distress, as well as reasonable attorney fees and costs. Importantly, a civil action can be pursued regardless of whether the individual responsible for the dissemination has been charged or convicted of a crime related to the violation.
