This bill introduces a new provision allowing courts in South Dakota to mandate global positioning system (GPS) monitoring for defendants charged with domestic abuse offenses. The court may require the defendant to wear a GPS device that actively tracks their location and alerts law enforcement if they enter restricted areas, as defined by protection orders. Additionally, the defendant must cover the costs of the GPS device and, with the victim's consent, provide the victim with a device that notifies them of the defendant's proximity to restricted locations.
Furthermore, the bill stipulates that before imposing GPS monitoring, the court must give the alleged victim an opportunity to suggest areas from which they want the defendant excluded. The court is also required to inform the victim about their rights regarding participation in the monitoring, the technology's functionality, potential sanctions for the defendant's violations, and available community support services. This comprehensive approach aims to enhance the safety of victims while ensuring they are informed and involved in the monitoring process.
