This bill amends existing South Dakota law to authorize booster clubs, along with other specified organizations, to conduct bingo games, lotteries, and utilize pull-tab devices without being classified as gambling. The amendments to Section 22-25-25 expand the list of organizations permitted to conduct these activities to include bona fide congressionally chartered veterans' organizations, religious, charitable, educational, fraternal, civic, service, and booster clubs. Additionally, the bill stipulates that proceeds from these activities must not directly benefit any individual, and it sets limits on compensation for services rendered during these events. It also clarifies that organizations must provide written notice to local governing bodies before conducting such activities.

Furthermore, the bill amends Section 22-25-41 to allow distributors or manufacturers to sell coin-operated mechanical pull-tab dispensing devices to specific organizations, including fraternal, charitable, civic, service, and booster clubs, as well as volunteer fire departments and congressionally chartered veterans' organizations. The legislation specifies that while these devices can be used in establishments not owned by the purchasing organization, all proceeds must be retained by the authorized organization. Overall, the bill aims to enhance fundraising opportunities for community organizations while maintaining regulatory oversight.
