The bill establishes the South Dakota-tribal consultation commission, aimed at enhancing cooperation and collaboration between the state and the nine federally recognized Indian tribes. This commission is designed to respect tribal sovereignty and self-governance, allowing tribal representatives to provide input on state affairs. The commission will consist of the Governor or a designee, the secretary of the Department of Tribal Relations or their designee, one representative from each federally recognized Indian tribe, one member of the House of Representatives, and one member of the Senate. The commission is required to meet at least once every three months and will elect a chair and vice chair during its initial meeting.
Additionally, the commission will receive administrative support from the Department of Tribal Relations and will require the Governor or their designee to report on state initiatives at each meeting, allowing for feedback from the commission regarding the impact of these initiatives on the tribes. An annual report detailing the commission's findings and recommendations must be submitted to the Governor by December 1st each year.
