The resolution calls for the South Dakota Attorney General to file a lawsuit against the People's Republic of China, the Chinese Communist Party, and the People's Liberation Army bioweapons laboratory in Wuhan, seeking $100 billion in damages related to the COVID-19 pandemic. It asserts that the SARS-CoV-2 virus, which causes COVID-19, originated from gain-of-function research at the Wuhan lab and has resulted in significant loss of life and strain on healthcare systems and communities in South Dakota.

Additionally, the resolution proposes the establishment of a South Dakota COVID-19 Victims Relief Fund. This fund would be managed by a committee comprising lawyers, medical professionals, financial experts, legislators, and victims, tasked with distributing any damages awarded from the lawsuit to South Dakota residents affected by the pandemic. Compensation would be available for various hardships, including death, illness, medical expenses, business closures, and loss of income, with a cap of $250,000 per individual upon verified proof of losses.
