This bill amends South Dakota law to expand the definition of "community safety zone" to include licensed and registered child care programs. Specifically, it adds licensed day care centers, licensed group family day care homes, and registered family day care homes to the list of facilities that create a community safety zone, which is defined as an area within five hundred feet of these sites, along with existing locations such as schools, parks, and shelters. The bill also clarifies that the area includes the facilities and grounds of these sites.

Additionally, the bill modifies the restrictions on where registered sex offenders can reside. It specifies that offenders cannot establish a residence within a community safety zone unless certain conditions are met, such as being incarcerated, on parole, or having established their residence before the community safety zone was created. The language regarding the types of facilities that constitute a community safety zone has been updated to reflect the new additions. Violating these residency restrictions is classified as a Class 6 felony, with subsequent violations escalating to a Class 5 felony.
