This bill introduces a new provision allowing the Public Utilities Commission in South Dakota to assess actual costs to data centers that are customers of public utilities. Specifically, the commission can charge these data centers for the costs incurred while processing requests for approval of contracts or electric service agreements that deviate from standard terms, provided that the data centers have a peak demand of ten megawatts or greater.
Additionally, any funds collected from these assessments will be directed to the state treasurer for deposit into the South Dakota Public Utilities Commission gross receipts tax fund. The bill defines a "data center" as a centralized facility primarily focused on the storage, management, dissemination, and processing of electronic data, which includes activities such as digital currency mining.
