The bill amends South Dakota's public notice requirements for meetings by clarifying the procedures for posting agendas. It specifies that the state must provide public notice of a regular meeting by posting the proposed agenda at the principal office of the relevant board, commission, or department, as well as on a designated state website. The proposed agenda must include the date, time, and location of the meeting, and it must be posted at least seventy-two hours before the meeting is scheduled to start. The bill also clarifies that the seventy-two hours does not include weekends or legal holidays.
Additionally, for special or rescheduled meetings, the bill mandates that notice must be delivered to local news media who have requested it, and that public notice must be provided in accordance with the same requirements as for regular meetings, as circumstances allow. The language changes include the insertion of terms such as "regular" and "must," while deleting phrases that were previously part of the law, such as "shall" and "by." A violation of these notice requirements is classified as a Class 2 misdemeanor.
