The bill amends existing laws regarding reinstatement fees and fees for obtaining an abstract driver record in South Dakota. Specifically, it modifies Section 32-35-47.1 to require individuals whose driving privileges have been suspended to pay a reinstatement fee as outlined in subsection 32-12-47.1(1)(f) before their license can be reinstated. Additionally, Section 32-35-101 is amended to establish that the department will charge a fee of seven dollars for each certified abstract of a person's operating record for the last three years, with the collected fees being credited to the state motor vehicle fund.
Furthermore, the bill clarifies that the three-year limit for obtaining an abstract does not apply when a person requests their own record. It also includes provisions to ensure that accidents involving law enforcement officers, firefighters, or emergency medical technicians while performing their official duties in emergency vehicles, as well as operators of emergency snow removal equipment responding to emergency calls, will not be recorded on their driving records. These accidents must be documented separately, ensuring that the records of these individuals remain unaffected by incidents occurring during their official duties.
