This bill grants the board of commissioners the authority to regulate certain intra-county land uses and construction projects. It introduces a new section to chapter 11-2, allowing the board to enact ordinances or resolutions that govern the construction or operation of infrastructure within public rights-of-way for proposed intra-county land uses. The board is required to designate an approving authority to oversee these activities. Additionally, applicants must notify any affected municipalities or townships before submitting their applications to the county and provide proof of this notification.
Furthermore, if county approval is necessary, the board or the approving authority must give at least ten days' notice to impacted municipalities or townships before making a decision. The bill stipulates that any decision made by the approving authority regarding the construction or operation of infrastructure is subject to the board's terms and conditions, as well as any applicable agreements with municipalities exercising joint jurisdiction. Importantly, the approval process does not prevent applicants from entering into mutual agreements with affected municipalities or townships concerning the infrastructure's operation.
