This bill introduces new provisions to South Dakota's liquor laws, specifically allowing individuals not licensed under chapter 35-4 to sell vintage distilled spirits to on-sale licensees. The legislation defines "vintage distilled spirit" as a distilled spirit that has not been distributed in the state for at least five years and permits sales of up to twenty-four liters per on-sale licensee annually. Sales must occur in person at the licensed premises of the on-sale licensee.
Additionally, the bill mandates that upon purchasing a vintage distilled spirit, the on-sale licensee must label the product clearly as "Vintage Distilled Spirit." Before selling the vintage spirits to consumers, the on-sale licensee is required to notify the Department of Revenue with specific details about the purchase, including the seller's information and the quantity of spirits acquired. Furthermore, the on-sale licensee is restricted to selling these vintage spirits only for consumption on their licensed premises.
