This bill introduces new provisions allowing individuals not licensed under South Dakota's liquor laws to sell vintage distilled spirits to on-sale licensees, with a limit of twenty-four liters per licensee per year. A "vintage distilled spirit" is defined as a distilled spirit that has not been distributed in the state for at least five years. The sale must occur in person at the licensed premises of the on-sale licensee. Additionally, upon purchasing such spirits, the on-sale licensee is required to label the product clearly as "Vintage Distilled Spirit."

Furthermore, the bill mandates that before an on-sale licensee sells the vintage distilled spirit to consumers, they must notify the Department of Revenue in writing about the purchase. This notification must include specific details such as the licensee's information, the seller's information, the brand and quantity of spirits purchased, the purchase date, and prior purchase history from the same seller. The on-sale licensee is also restricted to selling the vintage distilled spirits only for consumption on their licensed premises.
