This bill introduces a new section to South Dakota law that prohibits lawyers from preparing testamentary gifts for themselves or their relatives from clients, unless specific conditions are met. The conditions state that the lawyer or recipient must be related to the client, and the gift must not be significantly disproportionate to those given to other similarly related individuals. Any testamentary gift made in violation of this provision will be deemed invalid due to undue influence.

Additionally, the bill defines "related persons" to include a spouse, child, grandchild, parent, grandparent, cohabitant, or other close relatives of the lawyer. It is important to note that this new regulation will only apply to instruments executed on or after July 1, 2025.
