This bill aims to prohibit law enforcement agencies in South Dakota from engaging in any diversity, equity, or inclusion (DEI) programs. It defines DEI programs as practices or policies that promote differential treatment based on race, color, religion, sex, ethnicity, or national origin. The bill outlines several specific prohibitions, including the engagement in DEI programs, requiring employee participation in related training, spending public funds on DEI initiatives, and entering contracts with organizations that promote DEI. Additionally, it restricts the adoption of policies that influence workforce composition based on the aforementioned characteristics and prohibits the promotion of various theories related to bias and social justice.

To enforce these prohibitions, the bill grants the attorney general the authority to investigate alleged violations and initiate civil actions, with penalties not exceeding $5,000. If a law enforcement agency is found in violation, the attorney general must notify the agency and allow a 30-day compliance period, after which endorsements or licenses may be suspended if non-compliance continues. Furthermore, individuals required to participate in DEI programs in violation of the law, as well as crime victims affected by such programs, are given the right to bring civil actions against the law enforcement agency for damages and legal costs.
