This bill mandates that employees of school districts and institutions governed by the Board of Regents or the South Dakota Board of Technical Education must obtain written permission from a parent or guardian before addressing an unemancipated minor student with a name other than the student's legal name or a preferred title or pronoun that does not align with the student's biological sex. The bill defines "sex" based on biological characteristics present at birth, including chromosomes and genitalia.
Additionally, the bill protects employees from adverse employment actions if they choose not to address individuals in a manner inconsistent with their legal names or biological sex. It also ensures that students cannot face disciplinary actions for refusing to identify their pronouns or address others in a manner inconsistent with their legal names or biological sex. Both employees and students who experience violations of these provisions are granted the right to pursue civil action for relief, including monetary damages and attorney's fees, within two years of the violation.
