This bill mandates that employees of school districts and institutions governed by the Board of Regents or the South Dakota Board of Technical Education must obtain written permission from a parent or guardian before addressing an unemancipated minor student with a name other than the student's legal name or a preferred title or pronoun that does not align with the student's biological sex. The bill defines "sex" based on biological characteristics present at birth, including chromosomes and genitalia.
Additionally, the bill protects employees from adverse employment actions for refusing to use names or pronouns inconsistent with an individual's sex, allowing them to seek civil remedies if such actions occur. It also ensures that students cannot face disciplinary measures for not identifying their pronouns or for refusing to address others in a manner inconsistent with their legal names or biological sex. Students and employees are granted the right to pursue civil action for violations of these provisions within two years of the incident.
