The proposed bill mandates that all hospitals in South Dakota implement drug testing programs for their employees. It introduces new definitions for key terms, including "drug testing," which refers to the analysis of biological specimens to detect substances such as alcohol, amphetamines, cocaine, marijuana, opioids, and phencyclidine. Additionally, the term "employee" is defined to encompass full-time, part-time, temporary, or contracted staff members who receive compensation for their work.
By January 1, 2026, each licensed hospital must establish policies and procedures for a drug testing program that includes pre-employment drug testing for all prospective employees and random drug testing for current employees at least once a year. This initiative aims to enhance workplace safety and ensure a drug-free environment within healthcare facilities.
