This bill amends Section 49-7A-2 to clarify the status of the Statewide One-Call Notification Board as an agency under the Department of Public Safety. It specifies that the Board is funded by revenue from the one-call notification center and outlines the Department's role in assisting the Board with the development and coordination of the statewide one-call notification system. The Board is empowered to hire employees and contractors to aid in these efforts and is responsible for managing its duties, functions, and funds, with the Department assisting in the expenditure of these funds in accordance with state laws.
Additionally, the bill establishes the state one-call fund within the state treasury, ensuring that any interest earned on the fund is reinvested back into it. The one-call notification center may operate as a nonprofit corporation, providing a service for notifying operators of underground facilities about excavation plans. The bill also emphasizes that all operators must comply with the chapter's requirements, including membership in the one-call notification center and reporting the locations of their underground facilities. Noncompliance may result in penalties and civil liability, with any assessed penalties being collected and deposited into the one-call fund.
