An Act to prohibit the exercise of eminent domain for the construction of pipelines carrying carbon oxide.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That a NEW SECTION be added to chapter 49-7:

Notwithstanding the provisions of any other law, a company may not exercise the right of eminent domain to construct a pipeline for the preponderant purpose of transporting carbon oxide for disposal in geological storage or for geological sequestration.
