An Act to prohibit the manufacturing, delivering, distributing, and selling of food containing specified substances.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 39-4 be amended with a NEW SECTION:

Beginning July 1, 2025, it is a Class 1 misdemeanor for any person to manufacture, deliver, distribute, hold, offer for sale, or sell a food product for human consumption that contains:

(1) Brominated vegetable oil, CAS registry number 8016-94-2;

(2) Potassium bromate, CAS registry number 7758-01-2;

(3) Propylparaben, CAS registry number 94-13-3; or

(4) Red dye number 3, CAS registry number 16423-68-0.
