An Act to establish the crime of possession of a weapon or tools with intent to commit theft and to provide a penalty therefor.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 22-30A be amended with a NEW SECTION:

Any person who possesses any weapon or instrument specifically designed, adapted, or adopted for the commission of a theft or any explosive useful for the commission of a theft, with the intent to commit a theft, is guilty of a Class 1 misdemeanor.
