An Act to revise the process to vacate certain highways.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That chapter 31-18 be amended with a NEW SECTION:
Before a county or township may vacate, change, or relocate a section-line highway, the commissioner of school and public lands must review the proposal to vacate, change, or relocate the highway to ensure compliance with the requirements of this chapter. A section-line highway may only be vacated, changed, or relocated by the county or township if the commissioner of school and public lands approves the proposal. Any request to the commissioner of school and public lands under this section must include a legal description of the location of the section-line highway and a description of the action proposed. Any decision made by the commissioner of school and public lands under this section may be appealed as provided by chapter 1-26.
