Senate Bill 167

An Act to revise provisions regarding vehicle dealer warranty compensation.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 32-6B be amended with a NEW SECTION:

A manufacturer that issues a campaign, recall, service program, stop-sale order, or any other program to address a defect or safety concern must compensate the vehicle dealer pursuant to   32-6B-61. The manufacturer may not, in order to evade this duty:

(1) Alter or remove the price, name, or number of any vehicle part; or

(2) Provide a vehicle part at no cost.

In addressing the defect or safety concern, the manufacturer may not impose upon a vehicle dealer any form of cost recovery fee or surcharge.
