Senate Bill 149

An Act to create the Medicaid expansion fund and to transfer monies received as a result of expanding Medicaid eligibility.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. By June 30, 2024, the state treasurer shall transfer from the general fund the sum of $1 to the medicaid expansion fund, created in section 2 of this Act. These monies are the result of the temporary, five percent increase in the federal medical assistance percentage as a result of medicaid expansion, as authorized by the American Rescue Plan Act of 2021, Public Law 117–2,   9814.

Section 2. That chapter 28-6 be amended with a NEW SECTION:

There is established in the state treasury the medicaid expansion fund. Expenditures out of the medicaid expansion fund must be appropriated in the general appropriations act and be used to cover current and future medicaid expansion costs.
